Privacy-request information, including information you provide when exercising a privacy right or preference and information reasonably necessary to verify or fulfill the request where verification is required.

3. Cookies and Similar Technologies

We and our service providers use cookies, pixels, tags, local storage, and similar technologies to operate the Services and, where permitted, for analytics, personalization, advertising, and measurement.

We generally use the following categories:

Necessary cookies are required for functions such as security, navigation, checkout, account access, and other core site functionality.

Statistics cookies help us understand how visitors use the Services so that we can improve site performance and user experience.

Marketing cookies and technologies help us measure marketing, deliver or personalize advertising, and understand how advertising contributes to visits and purchases.

Preference cookies remember choices such as language preferences, login status, and other settings.

Depending on your location, optional cookies and tracking technologies may be used only after you provide consent, or may be used unless you exercise an applicable opt-out right.

You can review or change available cookie and privacy choices through the Your Privacy Choices page linked in the footer of our website. Some choices apply only to the browser or device on which you make them.

4. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients as reasonably necessary for the purposes described in this Policy:

Ecommerce and technology providers, including Shopify and providers that host or support our website, checkout, customer accounts, Community Space, and related infrastructure.

Payment providers that process purchases and payment transactions.

Fulfillment, shipping, and logistics providers, including warehouses, carriers, and other providers involved in delivering orders.

Customer-service and communications providers that help us communicate with customers and manage support.

Email and SMS providers, including Klaviyo, that help us manage subscriptions, communications, and campaign measurement.

Analytics providers that help us understand use of the Services and measure performance.

Advertising and social-media partners, including Google and Meta, where permitted by your privacy choices and applicable law.

Review and user-generated-content providers, including Judge.me.

Creator, affiliate, and attribution platforms, including Shopify Collabs and Trybe, that help us operate creator programs, manage or distribute content, attribute referrals or purchases, and administer related activities.

Fraud, security, and compliance providers that help protect MODL, our customers, and the Services.

Professional advisers, such as accountants, attorneys, insurers, auditors, and consultants.

Government authorities or other parties where legally required, or where reasonably necessary to protect rights, safety, property, or the integrity of the Services.

We may also disclose personal information as part of an actual or proposed merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or similar business transaction.

Service providers may process personal information on our behalf under contractual or other legal restrictions appropriate to their role.

5. Targeted Advertising, Sale, and Sharing of Personal Information

MODL does not sell personal information for money.

However, some U.S. privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough to include certain disclosures of personal information to advertising, social-media, analytics, or marketing partners. For example, these definitions may apply when pixels or similar technologies are used to measure advertising or show ads based on activity across different websites or services.

Where applicable, you may opt out of these activities through Your Privacy Choices, available from the footer of our website.

We also recognize qualifying browser-based universal opt-out signals, including Global Privacy Control (GPC), where required by applicable law. A GPC signal generally applies to the browser or device from which it is sent.

Traditional browser “Do Not Track” signals are different from GPC. Because there is no generally accepted standard for responding to traditional Do Not Track signals, the Services may not respond to those signals.

European Economic Area, United Kingdom, and Switzerland

If European or UK data-protection law applies to our processing of your personal information, the legal basis for processing depends on the purpose for which we use the information.

  • to perform a contract, such as processing and fulfilling an order or providing an account or service you request;
  • with your consent, such as for certain marketing, cookies, or tracking technologies where consent is required;

You can unsubscribe from promotional emails using the unsubscribe link in the message. You can opt out of promotional SMS messages using the instructions provided with those messages.

Unsubscribing from marketing is separate from requesting deletion of your personal information or exercising another privacy right.

We may continue to send non-promotional communications where necessary, such as order confirmations, shipping updates, account notices, or responses to customer-service requests.

10. Fraud Prevention and Automated Tools

We and our service providers may use automated tools to help detect and prevent fraud, abuse, and security risks.

For example, ecommerce and payment providers may evaluate transactions for fraud risk, flag transactions for review, place transactions or fulfillment on hold for review, or in some cases block a high-risk checkout attempt.

Where applicable law provides rights relating to automated decisions, we will provide those rights as required.

11. Data Retention

We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including to provide the Services, maintain business and transaction records, comply with tax, accounting, consumer-protection, privacy, and other legal obligations, resolve disputes, prevent fraud and abuse, and enforce our agreements.

Retention periods vary based on the type of information, the purpose for which it is used, legal requirements, applicable consent or privacy choices, and whether an ongoing relationship exists.

A request for deletion may be subject to exceptions that permit or require us to retain certain information.
